I may possibly be pulled into a nursing home neglect lawsuit. I answered my questions truthfully to the investigator about how we were very frequently understaffed and sometimes had to sometimes leave a patient that needed to be turned more than 2 hours.(and that was in the worst of times)
The problem is that you cannot document such in nurses notes. Could the opposition’s lawyer get me for fraudulent documentation?
The patient in question did not allegedly suffer the neglect until after my employment had long ended.

were you understaffed or did the charge nurses just fail to follow-up on the CNAs to see that work was done. (such as turning residents, tracking of BMs, completing all assignments on the days ADL list, meal %s tracked etcetera)
nurses and CNAs are responsible for the notes they write and sign off on. if you wrote one thing in the notes and failed to actually follow-up on issues you are responsible and have just admitted to lying in the notes. if you are a CNA and failed to perform and/or report these issues you are responsible and if you are a nurse and failed to follow-up on the CNAs you share in the responsibility as well.
ultimately the final responsibilty falls on the nursing home but if it is a matter of the residents basic needs not being met that responsibility will be shared by many…………..
